PERSONNEL 4000 FINGERPRINTING - NEW HIRES Policy Concerning Connecticut General Statute 10-221d Effective July 1, 1994, each applicant for a position with the Manchester school system shall be asked whether he/she has ever been convicted of a crime and whether there are any criminal charges pending against him/her at the time of application. Each person hired by the Manchester school system after July 1, 1994 shall be required to submit to state and national criminal record checks. In order to process such record checks, the following procedure will be followed: 1) No later than ten calendar days after the Superintendent or his/her designee has notified a job applicant of a decision to hire the applicant, or as soon thereafter as practicable, the Superintendent will schedule and complete a fingerprinting process in accordance with state police guidelines. The Superintendent shall also cause the applicant to complete other necessary documents and materials for submission to the State Police Bureau of Identification for the processing of state and national criminal record checks. The term applicant includes any person who left the employ of the Manchester school system and subsequently applies for a position after thirty (30) days from the last day of that employment. This provision, for former employees, does not apply to substitute teachers who meet the requirement of continuous employment defined in statute as Aemployed at least one day of each school year by such local or regional board of education.@ 2) Failure of the applicant to have his/her fingerprints taken within such ten-day period, without good cause, will be grounds for the withdrawal of the offer of employment. 3) Any person for whom criminal records checks are required to be performed pursuant to this policy must pay all fees and costs associated with the fingerprinting process and/or the submission or processing of the requests for criminal record checks. The Administration may waive the fee for certain hard to recruit part-time non-certified positions. 4) Upon receipt of a criminal record check indicating a previously undisclosed conviction, the Superintendent or his/her designee will notify the affected applicant/employee in writing of the results of the record check and will provide an opportunity for the affected applicant/employee to respond to the results of the criminal record check. 5) Decisions
regarding the effect of a conviction upon an applicant/employee, whether
disclosed or undisclosed by the applicant/employee, will be made on
a case-by-case basis. Notwithstanding the foregoing, the falsification
or omission of any information on a job application or in a job interview,
including but not limited to information concerning criminal convictions
or pending criminal charges, shall be grounds for disqualification from
consideration for employment or discharge from employment.
LANGUAGE FOR EMPLOYMENT APPLICATIONS 1. Have you ever been convicted of a felony or any other criminal offense, either within or outside the State of Connecticut? If so, identify the approximate date, location and nature of each such conviction on a separate sheet of paper and attach to this application. 2. Are any criminal charges currently pending against you either within or outside the State of Connecticut? If so, identify the jurisdiction in which such charges are pending, the nature of the charges and an explanation on a separate sheet of paper and attach to this application. 3. Are you currently enrolled in a program of deferred adjudication (e.g., accelerated rehabilitation, pre-trial drug or alcohol education pursuant to Conn. Gen. Stat. '54-56g)? If so, identify the jurisdiction in which such program is pending and an explanation of the nature of such program on a separate sheet of paper and attach to this application. I understand that if I am employed by the Manchester Board of Education I will be required to submit to a state and national criminal history records check for a period of 90 days from my date of employment and I will be required to submit to fingerprinting, at my expense, for purposes of submitting my fingerprints to the Federal Bureau of Investigation for a national criminal history records check. I further understand and agree that if I have been convicted of a crime which has not been disclosed to the Manchester Board of Education, the Board may immediately terminate my contract of employment (certified employee position) or dismiss me (non-certified employee position) in accordance with the provisions of Public Act No. 93-328. I hereby authorize any and all law enforcement agencies, current and former employers, credit agencies, and academic institutions to supply any information regarding my background to the Manchester Public School System and to its agents and employees, and I hereby release all such former employers, law enforcement agencies, credit agencies and academic institutions, their agents and employees from any liability arising from the supplying of such information.
